But this is exactly where the <strong>protection of Article 10 of the Rome III Regulation<\/strong> comes into play.<\/p>\n<p><strong>Your Way Out of the Divorce Dilemma: German Law Applies Even Abroad<\/strong><\/p>\n<p>If you live in a country that does <strong>not grant women equal access to divorce<\/strong>, you may still <strong>file for divorce in a German family court\u2014<a href=\"https:\/\/scheidung-beratung-online.de\/?page_id=2087\" target=\"_blank\" rel=\"noopener\">under German law<\/a><\/strong>, provided certain conditions are met.<\/p>\n<p><strong>What does Article 10 Rome III mean for you?<\/strong><\/p>\n<p>The <strong>Rome III Regulation<\/strong> determines which divorce law applies in international marriages. Normally, it\u2019s the law of the couple\u2019s last habitual residence. But:<\/p>\n<p>\ud83d\udc49 <strong>Article 10 Rome III<\/strong> makes an <strong>exception<\/strong>:<br \/>If the law that would otherwise apply <strong>does not grant one spouse equal access to divorce because of their gender<\/strong>, then <strong>the law of the court being seized applies\u2014German law<\/strong>, in your case.<\/p>\n<p><strong>This means:<\/strong> Even if you live in Saudi Arabia, Iran, or Afghanistan, <strong>German law may still apply<\/strong>, as long as you bring your case before a German court.<\/p>\n<p>\u00a0<\/p>\n<p><strong>Which countries deny women equal access to divorce?<\/strong><\/p>\n<p>Article 10 of the Rome III Regulation becomes especially important if you live in a country where:<\/p>\n<ul>\n<li><strong>Men can divorce unilaterally<\/strong>, and<\/li>\n<li><strong>Women need the husband\u2019s consent or must meet strict conditions<\/strong> (e.g. proving abuse or infertility)<\/li>\n<\/ul>\n<p>Such discriminatory systems are found in:<\/p>\n<ul>\n<li><strong>Saudi Arabia<\/strong><\/li>\n<li><strong>Iran<\/strong><\/li>\n<li><strong>Afghanistan<\/strong><\/li>\n<li><strong>Pakistan<\/strong><\/li>\n<li><strong>Yemen<\/strong><\/li>\n<li><strong>Kuwait<\/strong><\/li>\n<li><strong>Qatar<\/strong><\/li>\n<li><strong>United Arab Emirates<\/strong><\/li>\n<li><strong>Sudan<\/strong><\/li>\n<li><strong>Libya<\/strong><\/li>\n<li><strong>Syria<\/strong><\/li>\n<li><strong>Indonesia<\/strong> (partially)<\/li>\n<li><strong>Malaysia<\/strong> (partially)<\/li>\n<\/ul>\n<p>In these countries, the man can often divorce instantly without justification (so-called &#8222;talaq&#8220;), while a woman must either go to court, return the dowry, or meet special requirements.<\/p>\n<p><strong>This inequality triggers the application of German law under Article 10 Rome III.<\/strong><\/p>\n<p>\u00a0<\/p>\n<p><strong>German Courts Have Jurisdiction \u2013 Even if You Live Abroad<\/strong><\/p>\n<p>Even if <strong>neither spouse lives in Germany<\/strong>, German courts still have jurisdiction under <strong>\u00a7 98 FamFG<\/strong> if no foreign state is clearly competent\u2014e.g., because you have no nationality there or your husband moved away.<\/p>\n<p><strong>Example:<\/strong><br \/>You are a Lebanese citizen, married to a German citizen. You both live in Saudi Arabia.
